Permit to Install Applications & Negotiations
Horizon has prepared permit to install applications for literally hundreds of projects ranging in magnitude from minor applications to synthetic minor applications to major stationary source applications requiring permits subject to the federal (or state) Prevention of Significant Deterioration (PSD) rules. We have determined the applicability of Maximum Achievable Control Technology requirements, compliance monitoring, the many diverse requirements of the federal Standards of Performance for New Stationary Sources, compliance with the requirements in Section 126 (of the federal Clean Air Act), Best Available Control Technology (BACT), including BACT cost-effectiveness calculations, and the many other air regulatory requirements that regulators often impose. In our PSD determinations, of which we have prepared many, Horizon has negotiated novel, but legitimate and legal, major stationary source definitions to the benefit of our clients, and approved by the U.S. EPA.
We perform permit stewardship with our permit applications, meaning that we track the progress of the permit review by the regulatory agency and participate in negotiating permit conditions. We know the rules that apply to our clients’ operations and we strive to limit the amount of ‘ad-hoc’ permit conditions many regulators attempt to impose upon the permit applicant. A permit negotiation is just that, a negotiation, and often times there is substantial room for considering options other than the initial position of the regulator. We are experienced in the art of negotiating; we know the history of agency permits issued to similar sources and we know the rules and practices of the regulator. From that knowledge base, we can effectively develop as good a permit as possible for our clients.
